ARTICLE 1: PURPOSE
These General Terms and Conditions of Sale (GTC) and General Terms and Conditions of Use (GTCU) govern the rights and responsibilities of FOCUS TESTING LTD, hereinafter referred to as “the company,” and its customers, in the context of the online sale of international training courses through its website.
ARTICLE 2: PURCHASE CONDITIONS
Customers must be at least 18 years old and have the legal capacity to purchase training courses, or obtain the consent of a legal guardian if they are minors.
When placing their order, customers must provide accurate and complete information through the form available on the company’s website. This information includes all identification details necessary for processing the order.
The customer is responsible for the accuracy of the information provided. The company reserves the right to request verification of identity, eligibility, and the information provided if necessary.
ARTICLE 3: PRICING
3.1 Device Used:
The rates displayed on the company’s digital portal are expressed in the local currency of the user. FOCUS TESTING LTD uses an independent currency conversion tool.
All transactions are received in US dollars (USD), thus, we cannot guarantee the absence of additional bank fees charged to the customer.
It is the responsibility of the customer, if they wish, to take the initiative to contact the company to verify the amount in US dollars (USD) before any product purchase.
3.2 Payment Methods:
Training can be paid for by credit card or via PayPal. Customers also have the option to pay in installments. By selecting a payment method, the customer authorizes its use to settle their order.
The company reserves the right to change the prices of its training courses at any time. However, the prices applied will be those in effect at the time of the customer’s order.
In case of payment authorization failure or non-receipt of payment, the company reserves the right to suspend processing and delivery of the order. Furthermore, the company may refuse to honor an order if the customer has unpaid bills or is involved in a payment dispute.
3.3 Transaction Confirmation:
The customer will receive a payment confirmation including details of their purchase and the total amount including taxes.
The company’s digital records will serve as proof of communications, orders, and payments made. Orders and invoices are securely stored and may be consulted as evidence.
ARTICLE 4: DELIVERY
The training will be made available to the customer once payment has been made. An email containing the links and necessary information to access the purchased training will be sent to the customer.
The training materials will be downloadable by the customer, allowing them to engage with it. The company disclaims any responsibility in case of loss of these documents or loss of access codes to the personal space including access to the training.
Other elements, such as certificates of completion, will be made available in their personal space.
ARTICLE 5: RIGHT OF WITHDRAWAL AND REFUNDS
5.1 Withdrawal period:
Customers have a withdrawal period of 30 days from the purchase date to cancel their order. After this period, the right of withdrawal will no longer be applicable.
The request for withdrawal must be clearly made to the customer service, either via the contact form available on the site or by email at [email protected].
5.2 Refund:
Refund requests must be sent to customer service and will be processed by them. Refunds will be made using the original payment method.
The company disclaims any liability in case of bank delays. Customers should take these potential delays into account when expecting a refund.
The refund policy aims to ensure the integrity and fairness of the training.
Refunds will not be accepted in the following cases:
- As soon as the customer has completed 50% of the training,
- If the customer has received their certificate of completion,
- If the refund request is made after the 30-day withdrawal period,
- If the customer has requested a change in training or a modification of their order.
5.3 Refund of the unlimited access offer:
After purchasing an individual training, you have the option to buy access to 105 of our trainings for only $97. This special offer, which is an additional benefit for our customers who have already invested in a specific training, is also non-refundable. By acquiring this pass, you benefit from maximum flexibility to explore our entire catalog at your own pace.
Please note that the initial purchase of an individual training is a prerequisite for obtaining unlimited access and is independent of this additional purchase. The purchase of unlimited access in no way allows for a retroactive refund of individual trainings already purchased. Therefore, any refund request based on the subsequent subscription to the unlimited access offer cannot be satisfied.
ARTICLE 6: RESPONSIBILITIES
6.1 Responsibility of FOCUS TESTING LTD.
FOCUS TESTING LTD commits to providing the training and its content upon purchase. Should it be impossible to provide the service due to power outages, internet connection problems, or any other event beyond its control, FOCUS TESTING LTD cannot be held liable.
FOCUS TESTING LTD reserves the right to perform maintenance on its website. In such cases, FOCUS TESTING LTD commits to informing the customer as soon as possible and to minimize the duration of the maintenance.
6.2 Customer responsibility:
FOCUS TESTING LTD provides the courses and their content to the customer after purchase. It is the responsibility of the customer to understand and use these courses appropriately.
The courses offered by FOCUS TESTING LTD are intended for personal use only. The customer is not authorized to distribute or share the courses, in whole or in part. Any modification, sharing, translation, or other such actions, in whole or in part, for purposes other than personal use is strictly forbidden.
Upon the issuance of the certificate of completion, the customer is responsible for the use of the knowledge gained during the training.
In the event of maintenance on the FOCUS TESTING LTD site (see article 6.1), the customer agrees not to claim any compensation or refund.
ARTICLE 7: LIMITATION OF LIABILITY FOR THE APPLICATION OF COURSES.
FOCUS TESTING LTD offers online training for educational purposes only. The company is not responsible for the direct application of the knowledge acquired by customers during these trainings. As practitioner coaches, clients are responsible for their actions, decisions, and treatments towards their patients.
Customers agree to indemnify and hold harmless FOCUS TESTING LTD from any claim, liability, damage, or expense arising from misusing or misapplying the knowledge, techniques, or information acquired during FOCUS TESTING LTD training. FOCUS TESTING LTD disclaims any liability for errors, injuries, or consequences resulting from the application of course content in a clinical or coaching context.
Customers must ensure that their practice and application of the course content comply with professional standards and local regulations. The courses offered by FOCUS TESTING LTD do not replace the requirements for professional certification or accreditation in the fields of coaching or alternative medicine.
ARTICLE 8: LEGAL WARRANTY
FOCUS TESTING LTD guarantees that the product complies with the contract, subject to any claim under the legal warranty.
ARTICLE 9: INTELLECTUAL PROPERTY.
FOCUS TESTING LTD holds the rights to use the content of the website, including texts, graphic elements, logos, sounds, and software. Any reproduction or modification of the site’s elements is prohibited without permission.
ARTICLE 10: PROTECTION OF PERSONAL DATA.
The personal information of the customer (email address, name, etc.) will be used exclusively by FOCUS TESTING LTD and will not be transmitted to any third party. The customer has the option to request the deletion of this information, but they are aware that this will result in the permanent deletion of their access to their personal space.
ARTICLE 11: INTERNATIONAL SALES.
FOCUS TESTING LTD offers its training courses for sale worldwide. It is the responsibility of the customer to ensure that the certification obtained is recognized and valid in their country of residence or in the country where they wish to use it. FOCUS TESTING LTD is not responsible for the applicability or recognition of its certifications outside the jurisdiction where it operates and cannot guarantee their global acceptance. Customers are advised to perform the necessary checks to confirm that the chosen training meets the standards and recognition requirements needed for their professional or personal needs in their region.
ARTICLE 12: MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
The company reserves the right to modify these General Terms and Conditions of Sale and Use at any time. The changes will take effect as soon as they are published on the company’s website. Customers will be informed of any changes by notification on the website or by email. It is the customer’s responsibility to regularly check the terms and conditions to be aware of any changes.
ARTICLE 13: PARTIAL INVALIDITY
If any provision of these terms and conditions is declared null, illegal, or unenforceable, it will not affect the validity or enforceability of the remaining clauses.
ARTICLE 14: APPLICABLE LAW AND DISPUTES.
These General Terms and Conditions of Sale and Use are governed by the law in force in the country where the company is established. In the event of a dispute between the company and the customer, a friendly solution will be sought first. If no amicable agreement can be reached, the dispute may be submitted to the competent courts of the place where the company is established.
ARTICLE 15: SUBSCRIPTIONS AND CANCELLATIONS
15.1 Subscription:
Some website services are offered on a subscription basis. By subscribing, customers agree to recurring billing, charged according to the chosen payment method.
15.2 Cancellation:
Customers may cancel their subscription at any time by accessing their account on the “My Account” page or by sending an email to [email protected]. For monthly subscriptions, termination will take effect at the end of the current billing cycle.
15.3 Refunds of Annual Pass:
You can request a refund of your annual subscription. However, each course started will be deducted from your refund request, at a fixed price of 49 USD per course. In case of a billing dispute, you can contact customer service.
15.4 Monthly pass refund:
The Monthly Pass offers immediate access to all courses offered on the website. Due to this immediate access, no refunds will be made. If you wish to cancel your subscription, please refer to section 15.2 for the termination procedure.
ARTICLE 16: NON-REFUNDABLE WORKBOOKS
1. The Customer expressly acknowledges and agrees that all Workbooks sold on our Website are intangible digital content, digitally transmitted and immediately downloadable after purchase.
2. Due to the very nature of these products, which are digital and accessible upon purchase, all Workbook purchases are considered “final sales”. This means that, unless otherwise expressly provided by applicable law or other provision stated in these conditions, they cannot be refunded or exchanged once the purchase is made.
3. Consequently, by accepting the present general terms and conditions of sale, the Customer acknowledges having been duly informed of this exception to the right of withdrawal and accepts it accordingly.
4. If the Customer has any questions or concerns about the product they are about to purchase, they have the opportunity and full responsibility to contact our customer service for clarification before proceeding with their purchase.
5. Finally, we remind that under no circumstances can our company be held responsible for technical issues encountered by the user related to compatibility of formats, download time, loss of files, or other issues.
ARTICLE 17: ACCEPTABLE CONDUCT CLAUSE AND RIGHT TO REFUSE SERVICE
In order to maintain a safe and respectful environment for all our customers and staff, Focus Testing LTD reserves the right to refuse or restrict service to any customer whose behavior is deemed inappropriate, disruptive, or aggressive. If a customer continues to behave aggressively or insistently after all necessary information has been provided and all reasonable attempts at resolution have been exhausted, Focus Testing LTD may decide to prohibit them from using our services, at its discretion. This decision is taken very seriously and is used only as a last resort.
We are committed to providing excellent service to all our customers, but we must also protect the safety and well-being of our staff and customers. Moreover, Focus Testing LTD reserves the right to refund customers at its discretion, in accordance with our published general refund conditions in section 5.2. Any refund will be reviewed and processed to ensure customer satisfaction, in accordance with our fair internal standards and procedures.
